Planning Permission

Do You Need Planning Permission?

If you are proposing to change the use of a building or land from one use class to another, you will generally need planning permission. Most external building work associated with a change of use is also likely to require it.

Before you lease or buy a property for your business, you should always check whether planning permission is required for its intended use — and assess your chances of obtaining it. Alpha Hygiene Centre provides expert advice to guide you through the entire process.

Understanding A3, A4 & A5 Use Classes

UK planning law groups property uses into classes. Food & hospitality businesses typically fall under A3, A4 or A5.

A3

Restaurants & Cafes

Sale of food and drink for consumption on the premises. Includes restaurants, cafes, snack bars and coffee shops.

A4

Drinking Establishments

Pubs, bars and wine bars where the primary purpose is the sale of alcohol for consumption on the premises.

A5

Hot Food Takeaways

Sale of hot food for consumption off the premises. Includes chip shops, kebab shops, fried chicken outlets and similar.

When is Planning Permission Required?

  • Changing use from one class to another (e.g. A1 retail → A3 restaurant)
  • External alterations to the building (new signage, extraction units, external seating)
  • Extension or structural changes to the premises
  • Operating hours outside what is permitted by existing consent

There are some permitted development rights that allow certain changes of use without full planning permission. We will advise you on whether these apply to your situation.
